Terms of Service
These Terms of Service form a binding agreement between you and Mystic Forge, Inc., the operator of Protocol 88™, Origins Gate™, and all related platforms. All intellectual property is owned exclusively by Ecliptix Holdings LLC and licensed to Mystic Forge, Inc. By accessing or using any Mystic Forge service, you agree to these Terms without exception.
1. Definitions
“Mystic Forge” refers to Mystic Forge, Inc., the operator of all platforms and services. “Ecliptix Holdings” refers to Ecliptix Holdings LLC, the sole owner of all intellectual property. “Services” refers to all websites, applications, systems, games, tools, and community spaces operated by Mystic Forge. “User” refers to any individual accessing or using the Services.
2. Acceptance of Terms
By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use immediately. Continued use after updates constitutes acceptance of revised Terms.
3. Entity Structure & Ownership
All intellectual property—including but not limited to lore, mechanics, systems, artwork, designs, code, architecture, and narrative frameworks—is owned exclusively by Ecliptix Holdings LLC. Mystic Forge, Inc. operates the Services under a limited, revocable license. No rights are transferred to users under any circumstances.
4. User Accounts
You must provide accurate information when creating an account and maintain the confidentiality of your credentials. You are responsible for all activity under your account. Mystic Forge may suspend or terminate accounts at its sole discretion.
5. License to Use the Services
Mystic Forge grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes. This license may be revoked at any time for any violation of these Terms.
6. Prohibited Conduct
You agree not to: (a) reverse engineer, decompile, or attempt to extract source code; (b) scrape, harvest, or collect data by automated or manual means; (c) exploit bugs, vulnerabilities, or system behavior; (d) impersonate others or misrepresent affiliation; (e) engage in harassment, abuse, or harmful behavior; (f) interfere with platform stability or security; (g) create derivative works without explicit written permission from Mystic Forge and Ecliptix Holdings.
7. User-Generated Content (UGC)
If you submit or create content within the Services, you grant Mystic Forge a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, modify, reproduce, distribute, display, and create derivative works from your content. All rights associated with UGC flow upward to Ecliptix Holdings to maintain a clean chain of title. You waive any claims to compensation, attribution, royalties, or ownership.
8. No Expectation of Ownership
You acknowledge that all virtual items, currencies, characters, progress, and digital goods are licensed—not sold—to you. They have no monetary value outside the Services. Mystic Forge may modify, remove, or discontinue any virtual item at any time without liability.
9. Platform Integrity & Enforcement
Mystic Forge may take any action necessary to protect the Services, including suspending accounts, removing content, restricting access, or implementing technical measures. Enforcement decisions are final and made at Mystic Forge’s sole discretion.
10. Third-Party Services
The Services may integrate with third-party tools or platforms. Mystic Forge is not responsible for the actions, failures, or policies of third-party providers. Your use of third-party services is governed by their respective terms.
11. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind. Mystic Forge and Ecliptix Holdings disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted access, error-free operation, or immunity from security incidents.
12. Limitation of Liability
To the fullest extent permitted by law, Mystic Forge, Inc. and Ecliptix Holdings LLC are not liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of data, profits, goodwill, or virtual items. Your sole remedy is to discontinue use of the Services.
13. Indemnification
You agree to indemnify, defend, and hold harmless Mystic Forge, Inc. and Ecliptix Holdings LLC from any claims, damages, losses, liabilities, and expenses arising from your use of the Services or violation of these Terms.
14. Termination
Mystic Forge may suspend or terminate your access at any time, with or without cause. Upon termination, all rights granted to you under these Terms immediately cease.
15. Governing Law & Jurisdiction (U.S. Baseline)
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles, except where local law requires otherwise for international users. Subject to the arbitration agreement, any disputes that must be brought in court shall be brought exclusively in the state or federal courts located in Wyoming.
16. Changes to These Terms
Mystic Forge may update these Terms at any time. The updated version will be posted with a revised effective date. Continued use of the Services constitutes acceptance of the updated Terms.

18. Arbitration Agreement & Class Action Waiver
You and Mystic Forge, Inc. agree that any dispute, claim, or controversy arising out of or relating to the Services, these Terms, or your use of the platform shall be resolved exclusively through binding individual arbitration, and not in court. You waive the right to a jury trial and the right to participate in class actions, class arbitrations, private attorney general actions, or any other representative proceedings. Arbitration shall be conducted by a recognized arbitration provider under its applicable rules. The arbitrator has authority to resolve all disputes, including issues of arbitrability. The only exception to this arbitration requirement is that either party may bring an individual claim in small claims court if the claim qualifies. You may opt out of this arbitration agreement within 30 days of first using the Services by submitting a written notice to Mystic Forge, Inc. If you do not opt out, this arbitration agreement is binding and enforceable to the fullest extent permitted by law.
19. International Users & Region-Specific Terms
The Services are operated by Mystic Forge, Inc. from the United States. Users accessing the Services from outside the United States are responsible for complying with local laws. Certain provisions of these Terms, including the arbitration agreement and class action waiver, may not be enforceable in some jurisdictions. In such cases, only the unenforceable portion is modified to the minimum extent required by local law, and all remaining provisions remain in full force and effect. Regardless of location, all intellectual property rights, ownership terms, disclaimers, limitations of liability, and usage restrictions apply universally.
20. Global Compliance
Mystic Forge, Inc. operates globally and complies with applicable international laws to the extent required. Users accessing the Services from outside the United States are responsible for ensuring that their use complies with local laws and regulations. Nothing in these Terms shall be interpreted to require Mystic Forge to comply with any foreign law that does not apply to it as a U.S.-based entity.
21. International Data Transfers
By using the Services, you acknowledge that your information may be transferred to, stored in, and processed in the United States or other countries where Mystic Forge, Inc. or its service providers operate. These locations may have data protection laws that differ from those in your jurisdiction. Where required by law, Mystic Forge implements appropriate safeguards, such as contractual data protection clauses, to ensure lawful international data transfers.
22. Region-Specific Terms
Certain jurisdictions, including the European Union, United Kingdom, Australia, and others, provide consumers with rights that cannot be waived by contract. In such regions, the provisions of these Terms apply except where prohibited by local law. Only the specific portion that conflicts with mandatory local law is modified, and all remaining provisions remain in full force and effect.
23. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain fully valid and enforceable. The invalidity of one provision does not affect the validity of the rest.
24. No Conflict With Local Law
These Terms are intended to comply with applicable laws. If any provision conflicts with mandatory legal requirements in your jurisdiction, that provision is deemed modified only to the extent necessary to comply, and all other provisions remain unchanged.
25. Protection of Affiliates
All disclaimers, limitations of liability, indemnification obligations, and dispute resolution provisions in these Terms apply equally to Mystic Forge, Inc., Ecliptix Holdings LLC, their officers, directors, employees, contractors, agents, licensors, affiliates, and any future entities under common ownership or control.
26. No Class Actions or Representative Proceedings
To the fullest extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, collective, or representative action. This includes private attorney general actions and public injunction claims, except where such waivers are prohibited by local law.
27. No Public Injunction Relief
To the extent permitted by law, you waive the right to seek or obtain public injunctive relief or any remedy that would affect users other than yourself. If such a waiver is prohibited in your jurisdiction, the claim may be brought only in a court of competent jurisdiction after all individual claims subject to arbitration have been resolved.
28. No Representative Claims
You agree not to act as a representative or private attorney general on behalf of any other user or group of users. Any attempt to bring a representative claim is void to the fullest extent permitted by law.
29. International Jurisdiction
Except where prohibited by local law, all disputes shall be governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles. Where local law requires otherwise, disputes shall be governed by the mandatory laws of your jurisdiction, but all other provisions of these Terms remain enforceable.
